Section A: Our Collection, Use, and Disclosure of Personal Information

The Categories of Personal Information We Collect

We collect the following categories of personal information about you:

Personal details: When you create your FamCinema account, we collect your contact information (such as your email address) and authentication information for your login (such as a password). Depending on how you subsequently set up your account and method of payment, and which features you use, we also collect one or more of the following: first and last name, phone number, postal address, and other identifiers you provide to us.

Payment details: We collect your payment details, and other information to process your payments, including your payment history and billing address.

FamCinema account/profile information: We collect information that is associated with your FamCinema account and/or FamCinema profiles on your account (such as profile name and avatar, ratings and feedback you provide for FamCinema content), “ Your Purchases ” account/profile settings, and choices in connection with your use of the FamCinema platform.

Usage information: We collect information about your interaction with the FamCinema platform (including playback events, such as play, pause, etc.), choices made when engaging with interactive titles, FamCinema viewing history, search queries on the FamCinema platform, and other information about your use and interaction with the FamCinema platform (such as app clicks, text input, time and duration of access, and camera/photo access for QR-code and similar functionality).

Advertising information: If you subscribe to an ad supported program, we collect information about the ads on FamCinema (“Advertisements,” as defined in the FamCinema Terms of Use) that you view or interact with, device information (such as resettable device identifiers), IP addresses, and information provided by Advertising Companies (such as information about your likely interests they have collected or inferred from your visits to other websites and apps). We may use this information to display Advertisements to you in the FamCinema platform.

Device and network information: We collect information about your computer or other FamCinema capable devices you might use to access our service (such as smart TVs, mobile devices, set top boxes, and other streaming media devices), your network, and network devices. The information includes:

• device IDs or other unique identifiers, including for your network devices (such as your router), and devices that are FamCinema capable on your network;
• IP addresses (which can be used to tell us the general location of your device, such as your city, state/province, and postal code);
• device and software characteristics (such as type and configuration), referring source (for example, referrer URLs), standard web browser and mobile app log information, and connection information including type (such as wifi or cellular);
• performance data such as crash reports, timestamps, and debug log messages; and
• cookie data, resettable device identifiers, advertising identifiers and other unique identifiers (described below in the section “Cookies and Internet Advertising”).

Communications: If you communicate with FamCinema (such as contacting customer support), engage in our surveys or feedback requests, we collect the contents of such communications. We also collect details of communications that we send you (such as via email or within the FamCinema platform), and information about your interaction and engagement with these communications.

Where We Collect Personal Information From

We collect your personal information from the following sources:

• Directly from you: When you register with the FamCinema platform, update your FamCinema account or profile, correspond with us, or respond to our surveys, you may provide (and we will collect) the following categories of personal information: personal details, payment details, FamCinema account/profile information, and communications.
• Automatically when you use our service: We automatically collect the following categories of personal information in connection with your use of the FamCinema platform: FamCinema account/profile information, usage information, advertising information, device and network information, and communications.
• From Partners whose products and services you use: We may collect the following categories of personal information about you from third parties whose services you use to access, pay for, or interact with the FamCinema platform (“Partners”): personal details, payment details, usage information, and device and network information. The categories of personal information that Partners provide to us will vary depending on the nature of the Partner and your relationship with them. Our Partners may include your TV manufacturer, internet service provider, streaming media device provider, mobile phone carriers, or other companies who collect payment for the FamCinema platform. For example, Partners may provide us:
  • personal details (such as your email address), device and network information (such as IP addresses, device IDs, or other unique identifiers), or other personal information in order to activate the FamCinema platform, or present FamCinema content to you through portions of the Partner's user interface;
  • payment details (such as associated pre-paid promotions and billing information) if they are assisting with billing or collecting payment for the FamCinema platform; and
  • search queries and commands applicable to FamCinema that you make through Partner devices or voice assistance platforms.
• From other sources: We may collect the following categories of personal information about you from other sources: personal details, payment details, and device and network information. These sources include:
• Service Providers such as vendors, agents, and contractors that collect or provide personal information to FamCinema in connection with services they perform on our behalf (“Service Providers”). This may include Service Providers such as those that:
  • help us determine a general geographic location based on your IP address in order to customize our service and for other uses consistent with this Privacy Statement;
  • provide us with information to secure our systems, prevent fraud, and help us protect the security of FamCinema and our users;
  • provide us with payment processing services including payment or balance information, or updates to that information; and

  • Advertising Companies: If you subscribe to an ad supported subscription plan (planned for the future), we may collect advertising information about you from other sources, including (collectively referred to as “Advertising Companies”):
  • Advertisers that run Advertisements on FamCinema (“Advertisers“) may provide us with unique identifiers (for example, cookies or resettable device identifiers), demographic information and other information (such as information about your likely interests they have collected or inferred based on your activities online) in order to deliver Advertisements;
  • service providers that facilitate the sale, operations, and management of Advertisements (“Ad Service Providers“);
  • ad measurement companies that support FamCinema and Advertisers in understanding the effectiveness of Advertisements run on FamCinema (“Ad Measurement Companies”); and
  • online and offline information providers to support Advertisements (for example, by providing your general location information based on your device's IP address, such as city, state, and postal code).

How We Use Your Personal Information

We use your personal information to provide, maintain, improve, and promote the FamCinema platform, and to communicate with you. This involves using the categories of personal information listed above for the following purposes:

To provide our service including all features and functionalities, websites and apps, user interfaces, and content and software associated with the FamCinema platform. This includes personalized recommendations for FamCinema content that we think will be of interest to you. This may also include personalizing the features and functionalities of the platform, and localizing FamCinema content relevant to your geography in compliance with our content partners' licensing terms. We use the following categories of personal information for this purpose: personal details, FamCinema account/profile information, usage information, device and network information, and communications.

To administer and operate our business including purposes such as processing payments, sending transactional communications to you (such as confirmation of purchase or information about changes to your account), determining your internet service provider to support network troubleshooting issues, responding to your inquiries and requests, and assisting you with operational requests such as password resets. We use the following categories of personal information for this purpose: personal details, payment details, FamCinema account/profile information, usage information, device and network information, and communications.

To research, analyze, and improve our services such as analyzing and understanding our audience to improve our services and optimize FamCinema content selection and service delivery. This may also include processing your personal information in connection with any surveys you participate in. We use the following categories of personal information for this purpose: personal details, payment details, FamCinema account/profile information, usage information, device and network information, and communications.

To enable Partner integrations and promotions so that our Partners can promote the FamCinema platform and make it available to you through Partner devices and integrations, based on the specific relationship you have with the Partner. We use the following categories of personal information for this purpose: personal details, payment details, FamCinema account/profile information, usage information, device and network information, and communications.

To send marketing and informational messages including news and promotional communications about our service, new features, available FamCinema content, and special offers, as well as FamCinema marketing on third party services. Any of these messages, including FamCinema marketing on third party services, may be personalized for you or your likely interests. We use your personal information to present you with Advertisements. This also includes enforcing our terms, such as whether a particular device is permitted to use the account consistent with our Terms of Use. Who We Disclose Personal Information To

We may disclose your personal information to the following parties:

• The FamCinema family of companies: We share your personal information among the FamCinema family of companies (production companies) as needed for the following purposes: to provide our service; to administer and operate our business; to research, analyze, and improve our services; to enable Partner integrations and promotions; to send marketing and informational messages; to operate our ad supported programs; for safety, security, and fraud prevention; and to comply with law and enforce our Terms of Use.
• Service Providers: We use Service Providers to perform services on our behalf or to assist us with the provision of services to you. For example, we use Service Providers to provide communications, security, infrastructure and IT services, game-related services, to personalize and improve our service, and to process payments. We do not authorize them to use or disclose your personal information except in connection with providing their services (which may include maintaining and improving their services). Partners may process your personal information for the following purposes: to administer and operate our business; to research, analyze, and improve our services; to enable Partner integrations and promotions; and to send marketing and informational messages.
• FamCinema marketing providers: When we market FamCinema on third party services, some of those services, as well as the marketing Service Providers that we use to purchase, deliver, optimize, or measure our marketing (collectively “FamCinema Marketing Providers”) may receive information from us (for example, the steps completed in FamCinema membership process). Common uses of this type of information are to measure the effectiveness and optimize our marketing campaigns, and to avoid marketing to a device of a person that is already a FamCinema member. FamCinema uses contractual and technical measures designed to prevent FamCinema Marketing Providers from accessing information regarding specific shows or movie title selections you make, URLs you land on, or shows or movies you have watched on our service. We do not share information about title selections of shows or movies you have watched on our service. FamCinema Marketing Providers may process your personal information for the following purposes: to research, analyze, and improve our services; and to send marketing and informational messages.
• Advertising Companies: If you watch an ad supported program, we may share certain personal information with Advertising Companies (see definition above) in order to select Advertisements shown on FamCinema, to facilitate interaction with Advertisements, and to measure and improve effectiveness of Advertisements. These companies may process your personal information for the following purposes: to operate our ad supported programs.
• Promotional collaborations: We may collaborate with third parties to offer promotions. To fulfill these types of promotions, we and the third parties may use your personal information for the following purposes: to enable Partner integrations and promotions; and to send marketing and informational messages.
• Corporate transactions: In connection with a reorganization, restructuring, merger or sale, or other transfer of assets, we will transfer personal information provided the receiving party agrees to respect your personal information in a manner that is consistent with this Privacy Statement. We may disclose your personal information in such instances for the following purposes: to provide our service; to administer and operate our business; to research, analyze, and improve our services; to enable Partner integrations and promotions; to send marketing and informational messages; to operate our ad supported programming; for safety, security, and fraud prevention; and to comply with law and enforce our Terms of Use.
• Safety, security and fraud prevention: FamCinema and its Service Providers may disclose your personal information to third parties where we reasonably believe disclosure is needed for the purpose of: safety, security, and fraud prevention.
• Compliance with law and enforcing our Terms of Use: We may disclose your personal information as necessary to comply with applicable law, regulation, legal process, or governmental request, and processing necessary to protect against harm to the rights, property or safety of FamCinema, its users or the public, as required or permitted by law. We may disclose personal information for the following purpose: to comply with law and enforce our Terms of Use.

International Transfers of Personal Information

FamCinema operates from various countries around the world, as do its Service Providers, Partners, and other third parties to whom we may need to disclose your personal information, as described above. This means that when you use or interact with FamCinema, your personal information may be transferred to other countries that have different data protection laws than those where you reside.

However, whenever we transfer personal information to other countries, we ensure that the personal information is transferred in accordance with applicable data protection laws and this Privacy Statement. Specifically, we use a variety of contractual, technical, and organizational measures as appropriate for such transfers, including data protection agreements, technical protections, and practices to challenge disproportionate or unlawful government authority requests.

We provide supplemental information regarding certain aspects of the FamCinema platform in the section “Supplemental Privacy Disclosures for Certain Services and Regions” below. In addition, data protection laws in certain countries or regions may require us to provide additional or different information to disclosures above in this Privacy Statement. Section B: Your Rights and Controls

Your Privacy Rights

Access, correct, update, or delete your personal information: You have a right to confirm whether we process your personal information and to access and receive a copy of the personal information we process about you. You may also correct or update out-of-date or inaccurate personal information or request that we delete personal information that we hold about you.

To request a copy of your personal information, you may write to support@famcinema.com and request this information. In addition, under the “Account” section of our website, you can access and update information about your account, including your contact information, payment information, and various related information about your account. You must be logged in to access the “Account” section.

Objection, restriction, and withdrawal of consent: You can object to or request that we restrict processing of your personal information. If we have collected and are processing your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Right to complain: You have the right to complain to a data protection authority about our processing of your personal information but we encourage you to first contact us with any questions or concerns.

Right not to be subject to automated decision making: You may have a right not to be subject to a decision made solely using automated means, where such decision would have a legal effect on you or produce a similarly significant effect.

You can exercise the rights described above when we receive a verified request in accordance with applicable law.

Communication and Marketing Preferences

Email Messages. If you no longer want to receive certain communications from us via email or otherwise, please email us at support@famcinema.com and we will refrain from emailing you in the future. Alternatively, click the “unsubscribe” link in the email. Please note that you cannot unsubscribe from transactional messages from us, such as messages relating to your account transactions.

Matched Identifier Communications from FamCinema. Some third party services allow us to reach users with online marketing about FamCinema content or the FamCinema platform by sending privacy protected contact information to the third party. Privacy protected contact information means we use deidentification technologies to convert the original contact information (such as an email address or phone number) into a value (typically a long alphanumeric sequence of characters) to keep the original information from being revealed. The third party compares FamCinema's privacy protected contact information with privacy protected contact information in its own database and there will be a match only if you have used the same contact information with FamCinema and the third party. If there is a match, FamCinema can then choose whether or not to send FamCinema marketing to you on that third party service, and can optimize and better measure the effectiveness of such marketing.

Marketing of the FamCinema platform using cookies and similar technologies. To exercise choice around cookies or resettable device IDs collected for marketing of the FamCinema platform or FamCinema content on third party service, please use the tools described in the “Cookies and Internet Advertising” section below.

Section C: Access to Account and Profiles

Sharing your account with others: As a FamCinema member, if you share your account with others in your household, please ensure that they are aware of and have read this Privacy Statement. This Privacy Statement applies to their use of FamCinema (except sections that only apply to the member, such as those related to payments). Please note that the member controls the FamCinema account and all profiles, the information in the account and all profiles, and whether to share (or stop sharing) the account with individuals in their household.

If you share or otherwise allow others to have access to your account, they may be able to see viewing information and account information in the “Account” section of the service.Please note that viewing history, recommendations, “continue watching” and similar information may be made available through various features and user experiences, such as Partner interfaces that are integrated with the FamCinema platform.

Profiles: Profiles allow users on a FamCinema account to have a personalized FamCinema experience, built around the FamCinema content of interest to them, as well as separate watch histories.

Account Login Features: You may have the option to use certain account login features, such as email-based, or easier login to the FamCinema app on certain devices. Please note that any device that is logged into your account will remain logged in unless you log out of those devices (following the instructions in the section below).

Removing device access to your FamCinema account: Users of public or shared devices should log out at the completion of each session. If you sell or return a computer or FamCinema ready device, be sure to first log out. If you or other users on the account do not maintain the security of your email address, password, and signed-in devices, or fail to log out a device you sell or return, then subsequent users on that device will likely be able to access your FamCinema account, including your personal information, and make purchases.

Section D: Cookies and Internet Advertising

Use of Cookies

We, our Service Providers, FamCinema Marketing Providers, and Advertising Companies use cookies, other similar technologies (such as pixel tags), and resettable device identifiers for various reasons. This section explains the types of technologies used, what they do, and your corresponding choices. To choose whether or not to receive cookies and similar technologies, please see the section below “How can I exercise choice regarding these technologies?”

Cookies and Similar Technologies, Pixel Tags, and Resettable Device Identifiers

Cookies are small data files that are commonly stored on your device when you access websites and online services. The text in a cookie contains a string of numbers and letters that may uniquely identify a device and can contain other information as well. This allows the web server to recognize your browser each time it connects to that web server.

We use other technologies such as browser storage and plugins (for example, HTML5, IndexedDB, and WebSQL). Like cookies, these other technologies may store small amounts of data on a device. Pixel tags often work in conjunction with cookies. In many cases, declining cookies will impair the effectiveness of pixel tags associated with those cookies.

If you use a FamCinema app on a mobile device, tablet, or streaming media device, we may collect a resettable device identifier from your device. Resettable device identifiers can be used like cookies and are found on many mobile devices and tablets (for example, the “Identifier for Advertisers” on Apple iOS devices and the “Google Advertising ID” on Android devices), and certain streaming media devices. Like cookies, resettable device identifiers are used to make online advertising more relevant, and for analytics and optimization purposes.

Why Does FamCinema Use These Technologies?

We use these types of technologies for various reasons, including to provide our service (for example, by making it easy to access our service by remembering you when you return); to administer and operate our business, to research, analyze and improve our services (for example, to improve site performance, monitor visitor traffic and actions on our site, and to test the effectiveness of our user interface); to send marketing and informational messages (for example, to deliver and tailor our marketing, and to understand interactions with our emails, marketing, and marketing on third party services); as part of our ad supported programming; for safety, security and fraud prevention; and to comply with law and enforce our Terms of Use. These technologies enable FamCinema Marketing Providers to collect personal information (such as the pages you visit and device and network information) when you use our services, and FamCinema Marketing Providers may also collect information about your online activities over time across different websites.

We may use pixel tags in our emails to understand how members interact with our services. Our use of pixel tags helps us understand when links within messages are clicked, or the emails are opened.

FamCinema uses resettable device identifiers to display marketing for our service or FamCinema content on third party services, and to operate our ad supported programming (including delivering Advertisements to you).

How can I exercise choice regarding these technologies?

We do not currently respond to web browser “do not track” signals.

To exercise choice regarding resettable device identifiers

To exercise choice regarding FamCinema's use of resettable device identifiers (for marketing the FamCinema platform or FamCinema content, or as used in connection with our ad supported programming), please configure the appropriate setting on your device (usually found under "privacy" or "ads" in your device settings). If you choose not to allow this, you may still see marketing messages promoting FamCinema (and Advertisements if you select an ad supported program) on that device, but it will not be selected based on the use of a resettable device identifier. Note that your choice regarding the resettable device identifier is specific to that device.

To exercise choice regarding other similar technologies

In addition to any choices we may offer you in the FamCinema platform, there are several ways to exercise choice regarding technologies that are similar to cookies, such as browser storage and plugins (for example, HTML5, IndexedDB, and WebSQL). For example, many popular browsers provide the ability to clear browser/cache storage, typically in the settings or preferences area. See your browser's help function or support area to learn more. Most email clients have settings that allow you to prevent the automatic downloading of images, including pixel tags, and the automatic connection to the web servers that host those images. Other technologies may be cleared from within the application.

Sharing Functionality in our Service

You can use sharing functionality available in our service to disclose your personal information in the following ways:

• certain portions of our service may give you options to share information by email, and social or other sharing applications, using the clients and apps on your device; and
• social plugins and similar technologies that allow you to share information.

Social plugins and social applications are operated by third-party social networks, and are subject to their terms of use and privacy policies.

Security

We use reasonable administrative, logical, physical, and managerial measures to safeguard your personal information against loss, theft, and unauthorized access, use and modification. These measures are designed to provide a level of security appropriate to the risks of processing your personal information.

Unfortunately, no measures can be guaranteed to provide 100% security. Accordingly, we cannot guarantee the security of your personal information.

Retention of Personal Information

We may retain personal information as required or permitted by applicable laws and regulations, including to honor your choices, for our billing or records purposes, and as otherwise necessary to fulfill the purposes described in this Privacy Statement.

Specifically, we retain personal information for as long as necessary to provide our service; to administer and operate our business; to research, analyze, and improve our services; to operate our ad supported programming; for safety, security, and fraud prevention; and to comply with law and enforce our Terms of Use. Our retention of personal information is based on many factors such as your relationship with FamCinema (for example, whether you are a current FamCinema member), the nature of the personal information, our legal obligations, and the need to defend or resolve current or anticipated legal claims.

Other Websites, Platforms and Applications

The FamCinema platform may use or be provided features operated by third party platforms (such as the display of social media content, or the provision of voice controls), or contain links to sites operated by third parties. In addition, you may encounter third party applications that interact with the FamCinema platform. These third parties have their own privacy policies.

For example, you may be able to access the FamCinema platform through platforms such as smart TVs, mobile devices, set top boxes, and other internet-connected devices. These platforms have separate privacy statements, notices, and terms of use, which we recommend you review.

We may provide support for the FamCinema platform (such as an online support forum for FamCinema customer support). Information that you post or make available on such sites and forums are publicly available (unless otherwise noted on the site or forum).

Kids

You must be at least 18 years of age or older (or the age of majority in your country of residence) to subscribe to the FamCinema platform. Anyone under this age may only use the service with the involvement, supervision, and approval of a parent or legal guardian.

Changes to this Privacy Statement

We will update this Privacy Statement from time to time in response to changing legal, regulatory, or operational requirements. We will provide notice of any such changes (including when they will take effect) as required by law. Supplemental Privacy Disclosures for US Residents

These disclosures apply to residents of United States of America that have adopted comprehensive consumer privacy laws that are in effect (collectively “US State Privacy Laws”). These disclosures supplement the Privacy Statement.

Notice to California Residents

Notice at Collection

At or before the time of collection, the California Consumer Privacy Act (“CCPA”) requires that we provide a notice of our practices, including the categories of personal information collected, the purposes for which such information is collected or used, whether such information is “sold” or “shared”, and the criteria used to determine how long such information is retained. We have provided these details throughout this section of the Privacy Statement.

Personal Information We Collect

We collect or have collected in the preceding twelve months, the following categories of personal information from consumers:

• Identifiers such as name, email address, password, payment details, postal address, and information about your FamCinema account and/or FamCinema profiles on your account (such as profile name). We also collect IP addresses, identifiers from the devices you might use to connect (such as resettable device identifiers), cookie identifiers, and characteristics about the networks you use when you connect to our service.
• Additional categories of information listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) (“California Customer Records”) such as name, address, phone number, credit card or debit card number, and other payment details.
• Characteristics of protected classifications under California or federal law (“characteristics of protected classifications”) such as date of birth and gender if you subscribe to an ad supported program.
• Commercial information such as your purchase history and other products purchased or considered.
• Internet or other electronic network activity information (“internet activity information”) such as any information about your interactions with FamCinema, our Service Providers, or Partners, including choices you have made when engaging with interactive titles, or search queries on the FamCinema platform. When you subscribe to an ad supported program, we receive information provided by Advertising Companies (see definition above) such as information about your likely interests they have collected or inferred from your visits to other websites and apps.
• Geolocation data such as your general location based on your IP address (such as your city, state/province, and postal code).
• Audio, electronic, visual, thermal, olfactory or similar information (“audio/visual information”) such as voice recording when you contact our customer support team.
• Inferences we may make using the categories of personal information above in the context of the FamCinema platform.
• Sensitive personal information such as a FamCinema username in combination with the password, and payment details such as a credit card number.

Sources of personal information

We explain our sources of information in the section “Where We Collect Information From” above. For ease of reference, we collect the above categories of personal information from the following sources: directly from you; automatically when you use our service; from Partners whose products and service you use; from other sources such as Service Providers, FamCinema Marketing Providers, third party sites and forums, and publicly available sources; and Advertising Companies.

Uses of Personal Information

We use and have used in the past twelve months, each of the categories of personal information for one or more of the purposes described in the section “How We Use Your Personal Information”. For ease of reference, we use the personal information to provide our service; to administer and operate our business; to research, analyze and improve our services; to enable partner integrations and promotions; to send marketing and informational messages; to operate our ad supported programming where applicable; for safety, security and fraud prevention; and to comply with law and enforce our Terms of Use.

Categories of Personal information disclosed for a business purpose

We disclose and have disclosed in the past twelve months, the following categories of personal information for business purposes (see the section “Who We Disclose Personal Information To”): identifiers, California Customer Records, characteristics of protected classifications, commercial information, internet activity information, geolocation data, audio/visual information and inferences.

We disclose these categories of personal information to the following recipients: the FamCinema family of companies; Service Providers; Partners; FamCinema Marketing Providers; Advertising Companies; and entities engaged in connection with promotional collaborations, corporate transactions (if any), safety, security and fraud prevention, or for purposes of compliance with law and enforcing our Terms of Use.

Categories of Personal Information Sold or Shared

We engage in the sale and sharing and also have sold or shared (as defined under CCPA) the following categories of personal information in the last 12 months:

Categories of personal information “sold”: Our use of identifiers for FamCinema marketing activities may be considered a “sale” under CCPA (see section “Communications and Marketing Preferences” → “Matched Identifier Communications from FamCinema”).

Additionally, we use identifiers for marketing activities (such as behavioral advertisements promoting the FamCinema platform or FamCinema content through use of cookies and resettable identifiers) which can be considered “sharing” under CCPA (see section “Communications and Marketing Preferences” → “Marketing of the FamCinema platform using cookies and similar technologies”).

Categories of personal information used for “targeted advertising” (considered “sharing” under CCPA) in the context of our ad supported subscription plan (planned for the future) : identifiers and geolocation data (for example, Advertisers may select Advertisements to be displayed to devices in a specific city or state). We allow Advertisers to use these categories of personal information to deliver Advertisements on the FamCinema platform. Such use may be considered "sharing" under CCPA (see section “Advertising Choices (FamCinema Ad supported programming)”).

Business purpose of selling or sharing personal information

We engage in the sale and sharing and also have sold or shared (as defined under CCPA) the above categories of personal information for the following business or commercial purposes: to send marketing messages, and operate our ad supported programming.

Retention of Personal Information

We may retain personal information as required or permitted by applicable laws and regulations, including to honor your choices, for our billing or records purposes, and to fulfill the purposes described in this Privacy Statement. Specifically, we retain personal information for as long as necessary to provide our service; to administer and operate our business; to research, analyze, and improve our services; to operate our ad supported subscription plan (planned for the future); for safety, security, and fraud prevention; and to comply with law and enforce our Terms of Use. Our retention of personal information is based on many factors such as your relationship with FamCinema (for example, whether you are currently a FamCinema member); the nature of the personal information; compliance with our legal obligations; and/or defending or resolving actual or anticipated legal claims. We take reasonable measures to destroy or de-identify personal information in a secure manner when it is no longer required. Your California Privacy Rights

California residents have certain rights with respect to your personal information.

• Right to Know/Access. You have the right to request that we disclose: the categories and specific pieces of personal information we have collected about you; the categories of sources from which personal information are collected; our business or commercial purpose for collecting, using, disclosing, selling or sharing personal information; the categories of third parties to whom we disclose, sell, or share personal information; and the categories of personal information we have disclosed, sold, or shared about you for a business or commercial purpose. You also have a right to confirm whether we process your personal information, and to access and receive a copy of the specific personal information we have collected about you.
• Right to Correction. You have a right to request correction of any inaccurate personal information we hold about you.
• Right to Deletion. You have a right to request deletion of your personal information, subject to exceptions under applicable laws.
• You can assert these rights above when we receive a verified request from you. For information on how to exercise your rights, please see the “Your Rights and Controls” section of this Privacy Statement.

California Do Not Sell or Share My Personal Information. As of the date of this Privacy Statement, we may use certain categories of personal information to offer members an ad supported program or engage in FamCinema marketing activities. Under the CCPA, these activities may be considered “selling” or “sharing.” If you do not want us to sell or share personal information about you, you can learn how to make applicable choices by clicking the “Do Not Sell or Share My Personal Information” link located in the footer of FamCinema.com. Using these choices will not opt you out of the use of previously “sold” (as defined by the CCPA) personal information, or stop all behavioral advertising.

We do not knowingly sell or share (as defined by the CCPA) the personal information of minors under 16 years of age.

Some web browsers and extensions are compatible with Global Privacy Control (GPC), allowing them to communicate your preference to opt out from specific forms of data processing, including any “sale” or “sharing” of personal information. In California, we honor your choices expressed through the GPC settings if we detect such a signal, as required by applicable law.

Right to Limit the Use of Sensitive Personal Information. As described above, we do collect sensitive personal information such as your FamCinema username, password, and payment details, which could be considered types of “sensitive personal information.” However, we use these types of sensitive personal information only for the purpose of providing our service; administering and operating our business; and other permitted purposes as described in the Privacy Statement and not for a purpose which would require offering a choice to limit its use under the CCPA.

Authorized Agents. You have the right to exercise the rights described in this section using an authorized agent acting on your behalf. They can submit a request on your behalf to support@famcinema.com along with a statement, certifying as may be required, that the agent is authorized to act on your behalf. In order to verify the request, we may ask you to verify your identity and your authorization of the agent to make requests on your behalf.

Right to Non-Discrimination. You have a right not to be subject to discriminatory treatment for exercising any of your rights described under this section. We will not discriminate against you based on your exercise of any of your rights.

Notice of Financial Incentives

When you use FamCinema, you may choose an ad supported program for viewing. It is possible that some may interpret an ad supported subscription plan to fall within the meaning of a “financial incentive” for the purposes of the CCPA.

If you choose an ad supported program, you will be presented with Advertisements which may appear before, during, or after content viewed on FamCinema. In certain circumstances, some FamCinema content and features (such as downloading and viewing FamCinema content in other countries) may not be accessible as ad supported.

We believe the reduction in the normal cost of a program in an ad supported option, and our use of the categories of personal information described above to present relevant Advertisements to you represents a fair exchange to continue to provide members high-quality programming at a lower price or for no cost. When considering the extent of the reduction in the cost for viewing an ad supported program, we considered projected ad revenue generated by all members projected to participate and the overall revenue required by FamCinema to operate and innovate its business, produce the FamCinema content to entertain its members, and make a reasonable profit.

Personal Information Rights under US State Privacy Laws

This section applies to residents of US States outside of California that have adopted US State Privacy Laws.

Sale and Use of Personal Information for Targeted Advertising Purposes

We may use certain categories of personal information to offer members ad supported programming or engage in marketing activities as described above in this Privacy Statement. Some of these activities may be considered “selling” or “targeted advertising” under US State Privacy Laws depending on how you interact with us and the choices you make.

If you do not want us to “sell” or use your personal information for “targeted advertising purposes”, we advise you not to view ad supported programming.

In some US states, we may honor your choices expressed through Global Privacy Control (GPC) signals as required by applicable law.

Use of De-Identified Information

We may de-identify personal information in a secure manner when we determine it is appropriate as part of our business operations. We take reasonable measures to maintain and use the information in a de-identified manner. We do not attempt to re-identify such information, except as permitted under applicable law.

Other Personal Information Rights under US State Privacy Laws

To the extent applicable under US State Privacy Laws, you may have the following rights in connection with your personal information:

• A right to confirm whether we process your personal information and to access and receive a copy of the personal information we have collected about you.
• A right to request deletion of your personal information, subject to exceptions under applicable US State Privacy Laws.
• A right to request correction or update any inaccurate personal information we hold about you.
• A right to opt-out of “sale” or our use of personal information for “targeted advertising” purposes. You can learn more by clicking the “Do Not Sell or Share My Personal Information” link located in the footer of FamCinema.com.

You can assert these rights when we receive a verified request from you. For information on how to exercise your rights, please see the Your Rights and Controls section of this Privacy Statement.

Use of Authorized Agents

If you are a resident of a US state that gives you a right to use an authorized agent, they can submit a request on your behalf to support@famcinema.com along with a statement, certifying as may be required, that the agent is authorized to act on your behalf. In order to verify the request, we may ask you to verify your identity and your authorization of the agent to make requests on your behalf.For more information about how to access your information, including our verification process, please see Help Topics.

Appeals

If you are a resident of a US state that gives you a right to appeal a decision, you may appeal our decision denying your request. Requests to change our policies or practices are not grounds for appeal. You may request an appeal by contacting us at support@famcinema.com. Please provide the US state that you are writing from, accompanied with documentation regarding the decision you are appealing.

If you do not own a FamCinema account, we may not be able to respond to certain requests, including, for example, the right to access or delete personal information. Because we only collect limited personal information about individuals without an account, we are unable to verify requests from non-account holders to the standard required by the US State Privacy Laws.
